Rubbish Collection Finchley Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Collection Finchley provides waste and rubbish collection services to domestic and commercial customers. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing any booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Service means any rubbish, waste, junk, or bulky item collection, removal, loading, transportation, and related services provided by Rubbish Collection Finchley.

Customer means the person, business, or organisation that books or receives the Service.

Agreement means the contract between Rubbish Collection Finchley and the Customer for the supply of the Service, incorporating these Terms and Conditions.

Waste means any items, materials, or substances presented by the Customer for collection, removal, or disposal, excluding any prohibited or hazardous materials as set out in these Terms and Conditions.

Premises means the address or location at which the Service is to be provided.

2. Scope of Service

Rubbish Collection Finchley provides rubbish and waste collection services within Finchley and surrounding areas. The Service may include household waste removal, garden waste clearance, office and commercial rubbish collection, and the removal of unwanted items or bulky waste, subject to these Terms and Conditions.

The exact scope of the Service for each booking, including the type and approximate volume of Waste to be collected, will be agreed at the time of booking or upon arrival at the Premises. The Service does not include cleaning, dismantling of complex fixtures, or services not expressly agreed in writing.

3. Booking Process

3.1 Customers may request a booking by telephone, email, or online enquiry form. All bookings are subject to availability and confirmation by Rubbish Collection Finchley.

3.2 When making a booking, the Customer must provide accurate and complete information, including the Premises address, access details, type of Waste, estimated volume or weight, preferred collection date and time, and any relevant restrictions such as parking or loading limitations.

3.3 Any quotation provided prior to arrival at the Premises is based on the information supplied by the Customer and is therefore an estimate only. The final price may be adjusted if the actual Waste, access conditions, or work required differ from the description provided at the time of booking.

3.4 Rubbish Collection Finchley reserves the right to decline or cancel any booking at its discretion, including where the Waste is unsuitable for collection or where access to the Premises is unsafe or significantly restricted.

4. Quotes and Pricing

4.1 Prices are generally based on the volume and type of Waste, the labour involved, and any additional charges such as congestion, parking, or local disposal fees.

4.2 Any quote given prior to collection is an estimate only and is not binding until the Waste has been inspected on site. The operative will confirm the final price before commencing the Service.

4.3 If the Customer does not agree with the final price confirmed on site, the Customer may decline the Service, in which case no collection will be carried out. However, a call-out, survey, or attendance fee may apply where this has been stated to the Customer in advance.

4.4 All prices are stated in pounds sterling. Where applicable, VAT or any similar tax will be added at the prevailing rate and shown clearly to the Customer.

5. Payments and Invoicing

5.1 Unless otherwise agreed in writing, payment is due in full at the time the Service is completed and before Rubbish Collection Finchley leaves the Premises.

5.2 Payment may be made by cash, debit card, credit card, bank transfer, or other payment methods accepted by Rubbish Collection Finchley at the time of booking or collection.

5.3 For commercial Customers with an approved account, Rubbish Collection Finchley may issue an invoice after the Service has been provided. Invoices must be paid in full within the payment terms stated on the invoice. In the absence of any stated terms, payment is due within 14 days of the invoice date.

5.4 If the Customer fails to make payment by the due date, Rubbish Collection Finchley reserves the right to charge interest on the overdue amount at the statutory rate allowed in the United Kingdom, together with any reasonable costs incurred in recovering the debt.

5.5 Title to the Waste passes to Rubbish Collection Finchley only when full payment for the Service has been received, subject to compliance with applicable waste regulations.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by providing notice to Rubbish Collection Finchley.

6.2 If the Customer cancels the booking more than 24 hours before the scheduled collection time, no cancellation fee will normally apply, unless specific non-refundable costs have been incurred by Rubbish Collection Finchley, in which case these may be charged.

6.3 If the Customer cancels the booking within 24 hours of the scheduled collection time, Rubbish Collection Finchley may charge a cancellation fee to cover the allocated resources and any lost opportunity to undertake other work.

6.4 If the Customer is not present at the Premises at the agreed time, or if access is not possible due to circumstances within the Customer’s control, this may be treated as a late cancellation and a call-out or cancellation fee may be charged.

6.5 Rubbish Collection Finchley reserves the right to cancel or reschedule a booking in the event of adverse weather, vehicle breakdown, staff illness, safety concerns, or circumstances beyond its reasonable control. In such cases, Rubbish Collection Finchley will use reasonable efforts to notify the Customer and arrange an alternative collection time.

7. Customer Obligations

7.1 The Customer is responsible for providing safe, reasonable, and lawful access to the Premises and the Waste to be collected.

7.2 The Customer must ensure that any parked vehicles, gates, or obstructions are positioned or removed so that Rubbish Collection Finchley can safely load and remove the Waste.

7.3 The Customer must clearly identify the Waste to be collected and must not include any prohibited or hazardous items such as asbestos, clinical waste, chemicals, solvents, gas bottles, pressurised containers, car batteries, or other materials which Rubbish Collection Finchley is not authorised or equipped to handle.

7.4 If the Customer is unsure whether any particular items are acceptable, the Customer should seek clarification before the collection date. Rubbish Collection Finchley may refuse to collect any item that it believes to be hazardous, unlawful, or unsafe to handle or transport.

7.5 The Customer shall obtain any necessary permissions or permits required for access, parking, or loading, including but not limited to council permits for parking in restricted areas. Any fines or penalties arising from incorrect or missing permits due to the Customer’s omission may be charged to the Customer.

8. Waste Regulations and Duty of Care

8.1 Rubbish Collection Finchley operates in accordance with applicable UK waste management legislation and regulations. Waste is transported and disposed of only at authorised facilities, and the company aims to reuse or recycle materials wherever reasonably practicable.

8.2 A waste transfer note or other documentation may be provided in accordance with legal requirements. The Customer must give accurate information about the type and nature of the Waste to ensure compliance with duty of care obligations.

8.3 Once collected and lawfully transferred, the Waste becomes the responsibility of Rubbish Collection Finchley, subject to these Terms and Conditions and applicable legislation.

8.4 Rubbish Collection Finchley does not accept liability for any items that have been mistakenly presented as Waste and removed as part of the Service. It is the Customer’s responsibility to separate and keep safe any items that are not intended for collection.

9. Limitations and Exclusions of Liability

9.1 Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under English law.

9.2 Subject to the above, Rubbish Collection Finchley shall not be liable for any indirect, special, or consequential loss, including loss of profit, loss of business, loss of goodwill, or loss of anticipated savings, arising out of or in connection with the Service or these Terms and Conditions.

9.3 Rubbish Collection Finchley’s total liability to the Customer, whether in contract, tort including negligence, breach of statutory duty, or otherwise, arising out of or in connection with the Service shall, to the extent permitted by law, be limited to the total price paid or payable for the specific Service giving rise to the claim.

9.4 The Customer must report any visible damage to property or concerns about the Service as soon as reasonably possible and in any event within 48 hours of completion of the Service. Rubbish Collection Finchley will reasonably investigate any such reports and may request evidence, photographs, or access to the Premises.

9.5 Rubbish Collection Finchley is not liable for damage to underground services, concealed cables, pipework, fixtures, or structures that were not reasonably apparent or disclosed by the Customer.

10. Access, Health and Safety

10.1 Rubbish Collection Finchley reserves the right to refuse to carry out the Service or any part of it if, in its reasonable opinion, the conditions at the Premises present a risk to health and safety or may cause damage to property or vehicles.

10.2 The Customer must ensure that any areas to be accessed are reasonably clear, that stairways and pathways are safe, and that children and pets are kept at a safe distance during loading and removal activities.

10.3 Where access involves multiple flights of stairs, long walking distances, or unusual conditions, additional labour charges may apply. These will be explained to the Customer before work begins wherever possible.

11. Delays and Force Majeure

11.1 Rubbish Collection Finchley aims to attend bookings at the agreed time or within the agreed time window. However, arrival times are estimates and are not guaranteed.

11.2 Rubbish Collection Finchley is not liable for delays or failure to perform the Service where caused by events beyond its reasonable control, including but not limited to traffic congestion, adverse weather, accidents, road closures, strikes, civil disturbance, or mechanical breakdown.

11.3 In the event of a significant delay, Rubbish Collection Finchley will use reasonable efforts to notify the Customer and arrange an alternative time for the Service where necessary.

12. Complaints and Dispute Resolution

12.1 If the Customer is dissatisfied with any aspect of the Service, the Customer should raise the issue with Rubbish Collection Finchley as soon as practicable.

12.2 Rubbish Collection Finchley will use reasonable efforts to investigate complaints promptly and to reach a fair and practical resolution.

12.3 Nothing in this clause affects the Customer’s statutory rights under UK consumer law where applicable.

13. Data Protection and Privacy

13.1 Rubbish Collection Finchley may collect and process personal data relating to the Customer for the purposes of managing bookings, providing the Service, handling payments, and maintaining records.

13.2 Personal data will be handled in accordance with applicable data protection laws in the United Kingdom. Information may be shared with trusted third parties only where necessary for the provision of the Service, for payment processing, or where required by law.

13.3 Customers are responsible for ensuring that the contact details they provide are accurate and kept up to date so that Rubbish Collection Finchley can communicate effectively regarding bookings and services.

14. Variations to These Terms

14.1 Rubbish Collection Finchley may update or amend these Terms and Conditions from time to time. Any such changes will take effect when published or communicated and will apply to bookings made thereafter.

14.2 The Terms and Conditions in force at the time of the Customer’s booking will apply to that booking, unless a change is required by law or regulatory authority, in which case the updated terms may apply retrospectively where necessary.

15. Severability

15.1 If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or competent authority, such provision will be severed from the remaining Terms and Conditions, which shall continue in full force and effect.

16. Entire Agreement

16.1 These Terms and Conditions, together with any written quotation or confirmation of booking, constitute the entire agreement between the Customer and Rubbish Collection Finchley in relation to the Service and supersede any prior discussions, correspondence, or understandings.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, the Service, or their subject matter shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service.
